BUPP 705
Effective Date
April 27, 2020
Parties Involved
Provost initiated, Senate reported on positive review March 3, 2020, President approved April 27, 2020.
Summary of Changes
- Add exclusion in the case that we are required by law to dismiss someone (e.g., for failing to report violations of Title IX).
- Add changes to notifications necessary in Title IX cases and other rights of the complainant to attend, provide evidence, etc.
- Add changes to fact-finding in Title IX cases (delegating some of that to the Title IX office).
- Clarify faculty rights to appeal within the Title IX process.
- Address conflicts between an employment contract and dismissal policy.
- Address inability to appear on the part of the accused.
- Specify training for members of the Dismissal Committee.
- Clarify notice and response.
- Change process for suspension pending hearing.
- Remove the Board of Regents from the appeal process.
Reasons for Changes
The first four items above are necessary adjustments to rights and options for various participants in the dismissal process that were necessary in order to conform to legal and procedural elements of Title IX concerns and processes. The other revisions were necessary in order to (a) clarify the handling of specific issues that might arise during the process, such as conflicts between the policy and employment contracts, inability of the accused to appear at a hearing, and the potential need to suspend a faculty member pending a hearing; (b) make the process more robust by mandating annual training for members of the Dismissal Committee and clarifying notice and response; and (c) end the process at the level of the President, rather than retaining the possibility for further appeal.
